These Terms and Conditions (“Terms and Conditions”) and the associated Privacy Policy (“Privacy Policy”) govern your access to and use of the website and your engagement with Epektasis. You should read these Terms and Conditions and the separate Privacy Policy carefully before using this website.

The website is available for your use only on condition that you agree to these terms of use. By accessing/using the website, you are signifying that you agree to be bound by these terms.

The copyright for the content on this website is owned or licensed by Epektasis and is protected under the Copyright Act 1968 and by other copyright laws in both Australia and other countries. Material on this website may be reproduced, uploaded to a third party, distributed or transmitted without the specific written consent of Epektasis as long as it is reproduced unaltered, with due credit to the author and Epektasis, and with a link to the original web page. All custom graphics that appear on the website and all associated trademarks, are trademarks of Epektasis.
8. Epektasis Privacy Policy
The Epektasis Privacy Policy is a separate document which governs the use of information collected from or provided by you at the website. Epektasis encourages you to make feedback, suggestions, comments or requests (“comments”). These comments may be made on certain webpages or by email using the form below. If you do make comments, you acknowledge that unless confidentiality is specifically requested, comments will not be considered confidential or proprietary, and Epektasis will be under no obligation to keep such information confidential, and Epektasis will have an unrestricted, irrevocable, world-wide, royalty free right to use, communicate, reproduce, publish, display, distribute and use such comments in any manner it chooses.

The website contains many links to third-party websites and resources (“linked sites”). These linked sites are provided solely as a convenience to you, and unless specifically stated otherwise, are not necessarily endorsed by Epektasis. Links on the Epektasis site to external entities are not covered within this policy. The Terms and Conditions set out here and in the Privacy Policy only cover the domain name of www.epektasis.com.au.

Epektasis generally encourages and agrees to your linking to the Home page, or any other page on the website, without the need for agreement between yourself and Epektasis. If you do link to the site, a notification using the form below would be appreciated.
12. Jurisdiction
The website is provided for use by residents of any country but, to the fullest extent permitted by law, the laws applicable to the use of the website and to any disputes arising from the use of the website are the laws of the state of Victoria, Australia.
13. Disclaimer of Warranties
While Epektasis makes every effort to provide accurate information, Epektasis makes no representations or warranties about the accuracy, completeness, security or timeliness of the content, information or services provided by the website and disclaims all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties’ rights, and fitness for a particular purpose.
14. Limitation of Liability
If Epektasis is found responsible for any damages, Epektasis is responsible for actual damages only. In no event shall Epektasis, be liable for any incidental, indirect, exemplary, punitive and/or consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use of or inability to use the website.
15. Security
Epektasis uses PayPal for its online transactions:
– All online transactions are performed on PayPal’s website and are secured payments.
– Payments are fully automated with an immediate response.
– At no stage are your PayPal account details or credit card details visible to Epektasis.

The Epektasis website is also secured with Wordfence Security and Sucuri Security systems and has its own SSL Certificate. Epektasis exercises care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the Internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the Internet and hence accept no liability for any unintentional disclosure.
16. Delivery of goods and services
16.1 Physical goods
After ordering online, you will receive an email confirmation containing your order details (if you have provided your email address). We will normally confirm receipt of your order within a few minutes of ordering. We will attempt to send your goods via Australia Post within three working days; however if goods are unavailable, delivery will take a little longer. If you wish to query a delivery please contact us using the form below.
16.2 Digital Delivery
After ordering online, you will receive an email confirmation containing your order details (if you have provided your email address). We will normally confirm receipt of your order within a few minutes of ordering. We will attempt to send your software/license/access code/link via email or by direct transfer to the relevant webpage immediately. If you wish to query a digital purchase please contact us using the form below.
16.3 Workshops and presentations
Every effort is made to provide accurate and helpful content for workshops and presentations, however no guarantees are made as to accuracy. In particular, no guarantee, warranty or other assurance is implied for any decisions or actions taken by participants during, or as a result of, participation in a workshop or presentation.
16.4 Consultancies
Every effort is made to provide rigorous, accurate and timely fulfilment of consultancy projects. The specific terms and conditions of a particular consultancy project will be governed by the specific contract associated with that project in addition to these general Terms and Conditions and the associated Privacy Policy.
17. Refunds & Returns
If for any reason you are not completely satisfied with your purchase of a physical product from Epektasis, we will give you a seven day money-back guarantee from the time you receive the goods. Please email us using the form below within that time if you are not satisfied with your purchase so that we can resolve any problems.
This refund policy does not apply to goods which have been used, damaged after delivery, or if any attempt has been made to alter the product or if they have been dropped or broken. All products must be returned in their original condition. All postage and insurance costs are to be paid by the buyer. If the wrong product was shipped or the product was clearly damaged or defective when shipped, legitimate postage and insurance costs will be reimbursed. We recommend that you return the product via Registered Post and that you pre-pay all postage. You assume any risk of lost, theft or damaged goods during transit and therefore advise you take out shipment registration of insurance with your postal carrier. Epektasis will not be responsible for parcels lost or damaged in transit if you choose not to insure.
No refunds are possible for services such as workshops, talks, coaching, or consultancies except in cases of non-delivery of the service.
